Donald Trump is indicted on 88 felony counts, across four jurisdictions, for crimes he committed - many of them while he was serving as president. Trump's lawyer, John Sauer, argued before the U.S. Supreme Court that Trump shouldn't be prosecuted for the crimes that were committed while he was in office. Specifically, Sauer said that the following acts are official presidential acts that would be covered by presidential immunity: ordering the assassination of a political rival; ordering the military to stage a coup to keep the president in power after he lost an election; and selling our nation's nuclear secrets to a foreign adversary. Donald Trump, on trial in New York for 34 felony counts of falsifying business records, has denied any relationship with Karen McDougal and Stormy Daniels. Yet he arranged for them to be paid more than $100,000 each to cover up information they could provide about him, so that information would not hurt his election chances in the 2016 presidential election. Judge Juan Merchan is about to decide if Donald Trump is guilty of criminal contempt for violating the court's gag order at his election interference trial in New York. Assuming he holds Trump in contempt, that will represent a violation of Trump's conditions of pretrial release in his criminal cases. Why is this dire for Trump? Judge's have told him: one of the conditions he must obey while on release is that he not commit any new state, federal, or local offenses because if he does he can be revoked on pretrial release. The consequences of being found in criminal contempt may end up being even more damaging for Trump then he realizes - much more than the $1000 per violation money fines and 30 day per violation jail terms that he is now facing in Judge Merchan's court in New York. Day two of his criminal trial was no better for Donald Trump than day one. His friend and long-time associate David Pecker testified about the dirty "catch-and-kill" scheme they conspired to execute to assist Trump in his political pursuits. Pecker also testified that Trump was very detail-oriented, to the point of being a "micromanager." This directly undercut Trump's lawyer's contention during opening statements that Trump had no idea why he was writing multiple $30,000 checks (totaling $420,000 in all) on his personal checking account and delivering the checks to Michael Cohen. In essence, defense lawyer Todd Blanche was urging the jury to check their common sense at the courtroom door. Even worse for Blanche, at one point during the criminal contempt argument for Trump's repeated violation of his gag order, Judge Merchan told Blanche, "you're losing all credibility with the court". Given that the penalty for criminal contempt is up to 30 days in jail per violation, there is a very real possibility that Trump could end up in jail. Indeed, The New York Times reported that the United States Secret Service and other law enforcement agencies have been meeting to determine how they would handle Trump's incarceration if he is ordered jailed. Donald Trump has violated the gag order imposed by Judge Merchan in his New York criminal prosecution. Trump has repeatedly violated the gag order - talking about and endangering the witnesses in the case. Now NY District Attorney Alvin Bragg's prosecutors have filed a motion formally asking Judge Merchan to hold Trump in criminal contempt and fine him. New reports have revealed the prosecution witnesses that are prepared to testify at Donald Trump's first criminal trial and they spell real trouble for him. Donald Trump's longtime Chief Financial Officer Allen Weisselberg was sent back to Rikers Island after pleading guilty to committing perjury at Trump's New York fraud trial. There are two good news stories to report. First, a New York appeals court judge rejected Donald Trump's attempt to stop his trial from beginning on April 15th. But; in a lesser-covered development; Judge Juan Merchan shared how some of the jury selection procedures will work. People often refer to Trump's New York prosecution as the "hush money" case. However Glenn and others refer to it as an "election interference" case: Trump criminally falsified business records to cover-up hush money payments to gain unfair advantage in the 2016 presidential election. Judge Merchan has revealed how he will instruct the jury on the "nature of the case" at the start of the trial: "The allegations are in substance, that Donald Trump falsified business records to conceal an agreement with others to unlawfully influence the 2016 presidential election." So it looks like the person that put up the $175 million bond to stop New York Attorney General Leticia James from seizing Trump's properties - a guy named Don Hankey - is not actually credentialed to do business in New York. If it already wasn't crystal clear that Trump-appointed Judge Aileen Cannon should be removed from presiding over the prosecution of the very defendant who bestowed upon her a lifetime appointment as a federal judge, it is now beyond reasonable dispute. Judge Cannon ruled AGAINST Trump, denying his motion to dismiss the 32 espionage counts in his Florida federal prosecution, yet Trump then praised her and attacked Special Counsel Jack Smith for telling her - in a court filing - that she was wrong. However, Cannon denied the motion signaling that she will revisit it (and may very well grant it) once the trial starts, in which case Smith will not be able to appeal the dismissal. Given Cannon's pro-Trump bias, the public will never be able to have confidence in the outcome of Trump's Florida prosecution unless Cannon is removed and a fair, impartial and unbiased judge is assigned to preside over the case. It's been a really bad couple of days for two Trump-affiliated lawyers, John Eastman and Jeffrey Clark. After a bar counsel ethics trial, a California judge ruled that John Eastman - one of the architects of the fake elector scheme - should be disbarred, saying that his "actions were carried out with deceit or dishonesty" and his plan to derail Joe Biden's election victory "was unlawful and lacked any factual or legal support." Former DOJ official Jeffrey Clark is contending with his own disbarment hearing in Washington, DC. When given the opportunity to testify in the hearing Clark repeatedly pleaded the 5th - invoking his 5th Amendment right against self-incrimination. Of course, disbarment may be the least of Eastman and Clark's worries, as both are charged co-defendants with Trump in his Georgia state RICO prosecution. New York State court judge Juan Merchan seems fed up with the incessant attempts by Trump and his legal team to delay his criminal trial for interfering in the 2016 election by making hush money payments and falsifying business records to cover them up. Judge Merchan ruled that Trump's NY prosecution will begin with jury selection on April 15. In another legal development, a New York appeals court inexplicably reduced the amount of the bond Trump must put up to appeal the massive money judgement entered against him in his business fraud trial. The bond amount was suppose to be $464 million. Yet without any explanation, analysis, or citation to legal authority, the appeals court ordered the bond reduced to $175 million. This is an especially curious development as it comes just days after Trump boasted on social media that he had close to a half-billion dollars of cash on hand. The United States Supreme Court has dealt American democracy a gut-punch, ruling that state election authorities CANNOT keep an insurrectionist off the state presidential primary ballot... even after a state trial court and State Supreme Court ruled that a person HAD engaged in insurrection against the U. In a move that again highlights why Judge Aileen Cannon should be recused from presiding over Donald Trump's federal prosecution in Florida, she refused to set a trial date during a hearing on Friday. This is inexplicable given that Jack Smith proposed a trial date of July 8th and Trump's lawyers proposed one for August 12th. This prompted Jack Smith's prosecutor to tell Judge Cannon that the one thing the parties seem to agree on is that there can be a summer trial date - which would at least get the case tried before the November presidential election. The DC federal circuit court of appeals has unanimously ruled that Trump is not immune from prosecution for his January 6th crimes. Before dismissing the jury at the conclusion of the E. Jean Carroll defamation trial and just after they awarded Ms. Carroll $83.3 million for Trump's incessant defamation - Judge Lewis Kaplan told the jurors that he recommends they tell NO ONE that they served on the Trump jury. Although Judge Kaplan's motivation was undoubtedly to protect the jurors against the danger posed by Trump and his supporters, it's institutional insanity to make everyone else alter their lives and their behavior rather than address the source of the danger - Donald Trump. Trump endangers everyone who is involved in holding him accountable for his crimes and his civil wrongs. This includes witnesses; judges and their staff; prosecutors and their family members; and jurors. Trump is on pretrial release in four felony cases, both state and federal. The law provides that if someone is on release in a felony case, and there is clear and convincing evidence that the defendant poses a danger to even one person in the community, that person should be detained pending trial. Yet instead of doing what the law provides, the institutions of government have decided that every single person involved in the endeavor of holding Trump accountable should alter their lives rather than neutralize the threat by detaining Trump pending trial. A New York jury has issued its verdict in the second defamation case that E. Jean Carroll bought against Donald Trump: Trump must pay Ms. Carroll $83.3 million in compensatory and punitive damages. A year earlier, a jury awarded Ms. Carroll $5 million due to Trump defaming her on other occasions. Moreover, during closing arguments, Trump disrupted the proceedings by storming out when Ms. Carroll's lawyer told the jury that Trump acts like the rules don't apply to him. Of course, Trump's disruptive behavior directly and dramatically proved the exact point Ms. Carroll's attorney was arguing to the jury. Glenn says Donald Trump truly is the biggest loser when it comes to his court cases. He's lost both trials against E. Jean Carroll. He's lost his New York civil fraud trial, and we are simply awaiting Judge Engoron's decision regarding how much Trump will have to pay (or "disgorge"). And, when his namesake, The Trump Organization, was criminally convicted of a 15-year-long criminal scheme to defraud in the first degree, Trump essentially lost that case as well (albeit by proxy as he was not personally charged in that case).Trump fights every case in the court of public opinion. Today was not a particularly good day for justice. Although Peter Navarro was sentenced to four months in prison for contempt of Congress, the judge DID NOT order him to be taken into custody. This is reminiscent of Steve Bannon, who was also sentenced - back in October 2022 - to four months in prison for contempt of Congress, but has yet to to serve a single day of his sentence. Perhaps worst of all, Donald Trump took the stand today in his defamation trial in New York and, after Judge Kaplan told Trump he was prohibited from calling E. Jean Carroll a liar, Trump IMMEDIATELY called E. Jean Carroll a liar. Yet there was no sanction, no accountability, and no contempt finding. No one can accuse Donald Trump of being a strategic thinker. Donald Trump is as transparent as child when it comes to what he tries to accomplish with his lies, his disinformation, and his propaganda. As the 50 states continue to decide the question of whether Donald Trump should be disqualified from state election ballots pursuant to the 14th Amendment because he engaged in insurrection against the United States, it looks like one conservative Supreme Court Justice ruled on that issue previously. In the ruling handed down by the Colorado Supreme Court disqualifying Trump from the presidential ballot in Colorado, the court relied on a legal opinion authored by Neil Gorsuch when he was a federal appellate court judge. The issue was whether the states had the authority to ban from their election ballots a candidate who was disqualified under the Constitution. The Michigan Supreme Court has refused to review a case that sought to ban Donald Trump from having his name placed on the Republican primary ballot in Michigan. This ruling is unsurprising given the unique election laws and procedures in Michigan. If the Michigan Republican Party wants to place a name on its presidential primary ballot, it can put any name it likes, including someone who may otherwise be disqualified from holding public office. That may make little sense, but each state has the right to enact its own election laws and regulations, and Michigan has chose a . . . curious way to go about things. Notably, the Michigan Secretary of State has no legal authority to reject Trump's name even though he engaged in an insurrection. So the Michigan Supreme Court opted to not review the case, as it involved no violation of Michigan election laws. However, if Trump were to win the Republican nomination, the suit will be refiled and the court may then HAVE to review and resolve the case. Indeed, the attorney who brought the case on behalf of the Michigan voters has said he will refile the case if Trump ends up being the Republican nominee.
