Day two of his criminal trial was no better for Donald Trump than day one. His friend and long-time associate David Pecker testified about the dirty "catch-and-kill" scheme they conspired to execute to assist Trump in his political pursuits. Pecker also testified that Trump was very detail-oriented, to the point of being a "micromanager." This directly undercut Trump's lawyer's contention during opening statements that Trump had no idea why he was writing multiple $30,000 checks (totaling $420,000 in all) on his personal checking account and delivering the checks to Michael Cohen. In essence, defense lawyer Todd Blanche was urging the jury to check their common sense at the courtroom door. Even worse for Blanche, at one point during the criminal contempt argument for Trump's repeated violation of his gag order, Judge Merchan told Blanche, "you're losing all credibility with the court". Given that the penalty for criminal contempt is up to 30 days in jail per violation, there is a very real possibility that Trump could end up in jail. Indeed, The New York Times reported that the United States Secret Service and other law enforcement agencies have been meeting to determine how they would handle Trump's incarceration if he is ordered jailed. Donald Trump has violated the gag order imposed by Judge Merchan in his New York criminal prosecution. Trump has repeatedly violated the gag order - talking about and endangering the witnesses in the case. Now NY District Attorney Alvin Bragg's prosecutors have filed a motion formally asking Judge Merchan to hold Trump in criminal contempt and fine him. New reports have revealed the prosecution witnesses that are prepared to testify at Donald Trump's first criminal trial and they spell real trouble for him. Donald Trump's longtime Chief Financial Officer Allen Weisselberg was sent back to Rikers Island after pleading guilty to committing perjury at Trump's New York fraud trial. There are two good news stories to report. First, a New York appeals court judge rejected Donald Trump's attempt to stop his trial from beginning on April 15th. So it looks like the person that put up the $175 million bond to stop New York Attorney General Leticia James from seizing Trump's properties - a guy named Don Hankey - is not actually credentialed to do business in New York. If it already wasn't crystal clear that Trump-appointed Judge Aileen Cannon should be removed from presiding over the prosecution of the very defendant who bestowed upon her a lifetime appointment as a federal judge, it is now beyond reasonable dispute. Judge Cannon ruled AGAINST Trump, denying his motion to dismiss the 32 espionage counts in his Florida federal prosecution, yet Trump then praised her and attacked Special Counsel Jack Smith for telling her - in a court filing - that she was wrong. However, Cannon denied the motion signaling that she will revisit it (and may very well grant it) once the trial starts, in which case Smith will not be able to appeal the dismissal. Given Cannon's pro-Trump bias, the public will never be able to have confidence in the outcome of Trump's Florida prosecution unless Cannon is removed and a fair, impartial and unbiased judge is assigned to preside over the case. Donald Trump thinks he can do one political photo op - attend the funeral of a slain NYPD police officer - and it will erase the FACT that he sent a mob to the US Capitol on January 6th to "fight like hell" and "stop the steal." His supporters proceeded to attack, beat and assault more than 100 police officers. Trump responded by telling the attackers he "loves them," that the are "very special," and that they should "never forget" that day." It's been a really bad couple of days for two Trump-affiliated lawyers, John Eastman and Jeffrey Clark. After a bar counsel ethics trial, a California judge ruled that John Eastman - one of the architects of the fake elector scheme - should be disbarred, saying that his "actions were carried out with deceit or dishonesty" and his plan to derail Joe Biden's election victory "was unlawful and lacked any factual or legal support." Former DOJ official Jeffrey Clark is contending with his own disbarment hearing in Washington, DC. When given the opportunity to testify in the hearing Clark repeatedly pleaded the 5th - invoking his 5th Amendment right against self-incrimination. Of course, disbarment may be the least of Eastman and Clark's worries, as both are charged co-defendants with Trump in his Georgia state RICO prosecution. And both are also un-indicted co-conspirators in Trump's federal prosecution in DC. Only the best people. There can be no reasonable dispute but that the institutions of government - particularly the Department of Justice - apply the rules, the laws, and the Constitution differently to Donald Trump than to the rest of us. New York State court judge Juan Merchan seems fed up with the incessant attempts by Trump and his legal team to delay his criminal trial for interfering in the 2016 election by making hush money payments and falsifying business records to cover them up. Judge Merchan ruled that Trump's NY prosecution will begin with jury selection on April 15. In another legal development, a New York appeals court inexplicably reduced the amount of the bond Trump must put up to appeal the massive money judgement entered against him in his business fraud trial. The bond amount was suppose to be $464 million. Yet without any explanation, analysis, or citation to legal authority, the appeals court ordered the bond reduced to $175 million. The United States Supreme Court has dealt American democracy a gut-punch, ruling that state election authorities CANNOT keep an insurrectionist off the state presidential primary ballot... even after a state trial court and State Supreme Court ruled that a person HAD engaged in insurrection against the U. In a move that again highlights why Judge Aileen Cannon should be recused from presiding over Donald Trump's federal prosecution in Florida, she refused to set a trial date during a hearing on Friday. This is inexplicable given that Jack Smith proposed a trial date of July 8th and Trump's lawyers proposed one for August 12th. This prompted Jack Smith's prosecutor to tell Judge Cannon that the one thing the parties seem to agree on is that there can be a summer trial date - which would at least get the case tried before the November presidential election. In a stunning development, the Supreme Court not only decides to take up on appeal Donald Trump's absurd, baseless presidential immunity claim, but they won't even hear oral arguments in the case for nearly two months. The DC federal circuit court of appeals has unanimously ruled that Trump is not immune from prosecution for his January 6th crimes. In their opinion - the court pointed out the Constitution expressly states that presidents can be criminally prosecuted EVEN IF they're first impeached. Before dismissing the jury at the conclusion of the E. Jean Carroll defamation trial and just after they awarded Ms. Carroll $83.3 million for Trump's incessant defamation - Judge Lewis Kaplan told the jurors that he recommends they tell NO ONE that they served on the Trump jury. Trump endangers everyone who is involved in holding him accountable for his crimes and his civil wrongs. This includes witnesses; judges and their staff; prosecutors and their family members; and jurors. Trump is on pretrial release in four felony cases, both state and federal. The law provides that if someone is on release in a felony case, and there is clear and convincing evidence that the defendant poses a danger to even one person in the community, that person should be detained pending trial. Yet instead of doing what the law provides, the institutions of government have decided that every single person involved in the endeavor of holding Trump accountable should alter their lives rather than neutralize the threat by detaining Trump pending trial. A New York jury has issued its verdict in the second defamation case that E. Jean Carroll bought against Donald Trump: Trump must pay Ms. Carroll $83.3 million in compensatory and punitive damages. Today was not a particularly good day for justice. Although Peter Navarro was sentenced to four months in prison for contempt of Congress, the judge DID NOT order him to be taken into custody. This is reminiscent of Steve Bannon, who was also sentenced - back in October 2022 - to four months in prison for contempt of Congress, but has yet to to serve a single day of his sentence. Perhaps worst of all, Donald Trump took the stand today in his defamation trial in New York and, after Judge Kaplan told Trump he was prohibited from calling E. Jean Carroll a liar, Trump IMMEDIATELY called E. Jean Carroll a liar. Yet there was no sanction, no accountability, and no contempt finding. Today wasn't a good day for justice or for the equal application of our laws. But tomorrow is another day... No one can accuse Donald Trump of being a strategic thinker. Donald Trump is as transparent as child when it comes to what he tries to accomplish with his lies, his disinformation, and his propaganda. For example, when he posts lies like, "the prosecutors are not coming after me, they're coming after you," it's a rallying cry designed to dupe his followers into feeling like they have a personal stake in the Trump prosecutions. Of course, the reality is that it is Trump, not his supporters, who is facing 91 felony charges in four cases, both state and federal. In his recent post, Trump tipped his hand, making it clear that even he knows that he will be convicted at trial. We've seen this movie before: some government official, some prosecutor, some law enforcement agent does something to hold Donald Trump accountable for his crimes, and Trump posts things about the person designed to inspire his supporters to threats and violence against that person. Most recently, Maine Secretary of State Shenna Bellows followed Maine's elections laws and her oath of office, and disqualified Trump from the Maine ballot. So, of course, Trump posted Secretary Bellows' bio and the threats started pouring in. Trump is on pretrial release in four felony cases. The law provides that, when there is clear and convincing evidence that a person under felony indictment poses a threat to the community or any person in the community, that defendant is to be detained pending trial. Glenn says it's long past time that the institutions of government apply the nation's pretrial detention laws to Trump as those laws are applied to every other person who is pending trial in a felony case. As the 50 states continue to decide the question of whether Donald Trump should be disqualified from state election ballots pursuant to the 14th Amendment because he engaged in insurrection against the United States, it looks like one conservative Supreme Court Justice ruled on that issue previously. In the ruling handed down by the Colorado Supreme Court disqualifying Trump from the presidential ballot in Colorado, the court relied on a legal opinion authored by Neil Gorsuch when he was a federal appellate court judge. The issue was whether the states had the authority to ban from their election ballots a candidate who was disqualified under the Constitution. Here are the precise words of then-Judge (now Supreme Court Justice) Neil Gorsuch: "a state's legitimate interest in protecting the integrity and practical functioning of the political process permits it to exclude from the ballot candidates who are constitutionally prohibited from assuming office. The Michigan Supreme Court has refused to review a case that sought to ban Donald Trump from having his name placed on the Republican primary ballot in Michigan. This ruling is unsurprising given the unique election laws and procedures in Michigan. If the Michigan Republican Party wants to place a name on its presidential primary ballot, it can put any name it likes, including someone who may otherwise be disqualified from holding public office. That may make little sense, but each state has the right to enact its own election laws and regulations, and Michigan has chose a . . . curious way to go about things. Notably, the Michigan Secretary of State has no legal authority to reject Trump's name even though he engaged in an insurrection. So the Michigan Supreme Court opted to not review the case, as it involved no violation of Michigan election laws. However, if Trump were to win the Republican nomination, the suit will be refiled and the court may then HAVE to review and resolve the case. Indeed, the attorney who brought the case on behalf of the Michigan voters has said he will refile the case if Trump ends up being the Republican nominee. The Colorado Supreme Court has heard oral arguments on whether the 14th Amendment's disqualification clause means Trump will have his name taken off the presidential ballot. Glenn reviews some of the arguments made by the parties and highlights some of the absurd positions taken by Trump's lawyers. For example: they are claiming that the January 6th attack on the US Capitol wasn't really an insurrection because "it only lasted three hours" or because "it only targeted one building." Then, the DC federal circuit court of appeals largely affirmed the gag order Judge Tanya Chutkan imposed on Donald Trump, trying to address his dangerous speech and posts. The unanimous appellate court ruling stated, “Mr. Trump’s documented pattern of speech and its demonstrated real-time, real-world consequences pose a significant and imminent threat to the functioning of the criminal trial process in this case.” The court opinion also noted that many of the individuals Trump verbally attacked “have been subjected to a torrent of threats and intimidation from his supporters.” Glenn says perhaps the most encouraging sentence in the entire 68-page opinion is the following: "In this case, the general election is almost a year away and will long postdate the trial in this case." This time in our longform weekend podcast - Glenn runs down the legal stories of the week. First, Donald Trump said during Sean Hannity's interview - if he's elected - he'll be a dictator on day one. Even worse, he just put something in a new court filing in his criminal case in DC that indicates he also intends to act like a dictator in his criminal case - deciding legal issues himself rather than waiting for or abiding by legal issues as decided by Judge Tanya Chutkan.
